The complainant has requested information, in an Excel spreadsheet or csv file, from the Non Domestic Energy Performance Certificate Register. The Department for Communities and Local Government (DCLG) refused to provide the information citing regulation 6(1)(b) – information is publicly available and easily accessible. The Commissioner’s decision is that regulation 6(1)(b) does not apply to this request. The Commissioner requires DCLG to issue a fresh response to the complainant’s request under the terms of the EIR.
